Accident and Compensation Law
The first meeting in accident cases is always free of charge
It is crucial to seek proper legal advice regarding your right to compensation if you suffer personal injury—whether from a traffic accident (where the injured party is usually insured and entitled to compensation) or a workplace or leisure accident. Employers are legally required to insure employees against accidents that occur during work. For leisure-time accidents, the applicable insurance policies are those in effect on the day of the accident.
Our lawyers at LAND also have extensive expertise in other areas of tort law. If you believe you are entitled to compensation, contact us and we will review your case.
The process in accident and compensation cases
We guide you through every step—from the first conversation to the final settlement. Here is an overview of the main stages in accident and compensation cases.
Accident notification
People who are involved in an accident report the personal injury to the relevant insurance company. We assist injured parties in reporting the injury if this has not already been done.
1Initial data collection
We request certificates/medical records from the healthcare institution that the injured party first visits following the accident.
2Insurance company position
After the initial documents are received, we send them to the relevant insurance company. The insurance company then takes a position on liability in the case.
3Compensation liability
Once the insurance company has accepted liability, it becomes possible to request reimbursement for out-of-pocket expenses related to the accident, such as medical visits, physiotherapy, and prescription medications.
4Stability point
Once the insurance company has accepted liability, data collection is put on hold until a certain stability point is reached. Typically, data collection begins approximately 10 months after the accident date.
5Final data collection
When the stability point is reached and it becomes clear whether the injured party experiences permanent consequences from the injury, further data collection begins. Final documents are then requested from the healthcare providers the injured party has consulted regarding the accident.
6Assessment process
When final documents have been received regarding the personal injury, a data bank is prepared for assessors who evaluate the permanent consequences of the accident. This prepares the work for the assessors before the assessment meeting. The entire assessment process takes approximately 6 months.
7Settlement
We handle submitting the compensation claim based on the assessment. Most often, an agreement is reached on compensation payment between the relevant insurance company and us, but if not, our lawyers proceed with litigation.
